PRIVACY & COOKIES POLICY

We, the boons Inc. understands the importance of your personal privacy. We provide this Privacy and Cookies Policy regarding personally identifiable information and data (“personal information”). This policy applies to our websites, the boons mobile site, boons app (also known as “boons ride”) for iphone, Android and other mobile applications, email and text messages, and social media accounts (the “Platforms”). When you use the Platforms, you agree to the terms in this policy.

Collection of Your Personal Information
Your Information: We may collect some information from you, when you visit or use boons platforms. This includes information that can identify you (“personal information”), including your first and last name, birthday, gender, email address, telephone number, postal address, and billing information (such as card holder name, credit card number, and expiration date). You can choose not to provide information to us, but in general some information about you is required in order for you to register as a member, use our services and/or book rides. You can also choose to store personal information in your user account for future bookings.

Mobile Apps: Each Mobile App also sends us the device’s unique device identifier (or “UID”), a sequence of numbers or characters that are unique to your mobile device. We use this only on the first opening of the Mobile App so that we can confirm to our advertising networks the number of downloads resulting from clicks on their respective ad banners and other marketing tools.

Companion Information: When you make a reservation for someone else through our platforms, we will request personal information about that individual. You should obtain the consent of other individuals prior to providing us with their personal information, as any access to view or change their information will be available only through your account.

Information from Other Sources:We collect your personal information from third parties. This can include when you log in using a third-party platform, social media accounts such as Facebook, Instagram etc. In addition, we also integrate third party software that collects information about users for security reasons. We collect information about you over time and across different websites when you visit the Platform(s). We also use tracking tools like cookies and beacons. This collects some information (IP Address, Web Browser software etc.) about your computer when you visit our platform(s). We also may collect information about your online activity, such as trips viewed and bookings made.

Customer support: If you choose to contact our customer support services, we will collect any inquiries, complaints or other information that you may submit to our support team.

When you give us personal information, you are telling us that the information is true, accurate, complete and current. You are also telling us that you have the authorization to provide it to us

Use of Your Personal Information
Bookings: We use sensitive information such as credit card details for the purpose of completing the ride bookings you select through our platforms.

Marketing: We use your information for marketing purposes. You have control regarding our use of Personal Data for directing marketing. Specifically, and where required by law with your prior consent, we may contact you to provide marketing material, promotions, to request feedback on your experience using our services or platforms, or to assist us in improving our offerings. If you would prefer not to receive notices of special savings or promotions, you may simply opt-out from receiving them by using the unsubscribe hyperlink provided in any communication or email us. You cannot unsubscribe from servicing emails and administrative messages that are considered part of your account membership unless you cancel your membership.

Legal: In certain cases, we may need to use your information to handle and resolve legal disputes, for regulatory investigations and compliance or to enforce the terms of use of the service.

Sharing of Your Personal Information
The boons Inc. may share your Personal Data with its subsidiaries and affiliated companies and with third parties as described in the categories below:

Service providers: We may share your personal information with the ride sharing companies or service providers with whom you selected to book your ride. These service providers are not controlled by boons and personal information disclosed to them is subject to the applicable service provider’s data privacy policy. Therefore, we encourage you to review the privacy policies of any service provider whose services you purchase through our platforms.

Third Party Vendors: We may share your personal information with suppliers who perform services such as credit card processing, call center agents, marketing etc. on our behalf and have agreed in writing to protect and not further disclose your information.

Business partners: We may share your personal information with various business partners. If a third party is involved in a product or service you have requested then their name will appear, either alone or with ours. If you choose to access these optional services, we may share information about you, including your personal information, with those partners. Please note that these business partners have their own data privacy policies.

Corporate affiliates and transfer of ownership: We may share your personal information with our corporate affiliates, and if boons may be acquired by sales of assets or otherwise changes control, the acquiring company would have access to your personal information for the uses set out herein.

Public Information: If you provide us a review of your trip, you authorize us to publish it on all our Platforms under the screen name you provided. You also authorize us to aggregate it with other reviews.

Compliance with Law and Other Disclosures: In response to subpoenas, court orders, or other legal process; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases we reserve the right to raise or waive any legal objection or right available to us. We may also release Personal Data to enforce or apply the terms and conditions applicable to our products and services, protect us or others against fraudulent or inappropriate activities, or otherwise protect the rights, property or safety of boons, our affiliated companies, our customers, or others.

We may also share anonymous aggregated usage information with others.

Storing and Protecting Your Personal Information
The security of your personally identifiable information is very important to us. We want you to feel confident about using our platforms, and we are committed to protecting the information we collect. We are a USA based company. Our servers and data centers are located in the U.S, and our service providers may be located there and in other countries. By providing us personal information, you agree that your personal information may be transferred to and stored in these countries. These countries may have different and/or less stringent privacy/data protection and data security rules than those of your own country. As a result, your personal information may be subject to access requests from governments, courts, or law enforcement in those countries, according to laws in those countries. Subject to the applicable laws in such other countries, we will provide the necessary safeguards to maintain protections of your personal information.

Data collection and Use
boons merchant app may collect and store general location information (such as IP address). If you permit the Services to access location services through the permission system used by your mobile operating system (“Platform”) or browser, we may also collect and store the precise location of your device when the boons app is running in the foreground or background of your device. This information may be used to help you find nearby pos bluetooth devices to auto print receipts for customers, if your Buletooth printer/any printer is connected. It’s used to enhance your user experience and improve the services.

boons collect driver’s location data (latitude and longitude), when the delivery app is enabled and running in online mode. We may collect the exact or precise location of the driver at a given time to locate the nearby drivers and send them the delivery request details. The location information is also used to provide the most optimized route to the pickup and destination locations.

Retention Periods
We will retain your personal information for as long as your account is active and for a period of time thereafter to allow you to re-activate your account without loss of information.

We will also retain your personal information as necessary to comply with our legal obligations, resolve disputes and enforce our contracts.

Protection for Children:
We generally do not collect personally identifiable information from children under the age of 13. If at any time in the future we plan to collect personally identifiable information from children under 13, such collection and use, to the extent applicable, shall, when required, be done in compliance with the Children’s Online Privacy Protection Act (“COPPA”) and appropriate consent from the child’s parent or guardian will be sought where required by COPPA. When we become aware that personally identifiable information from a child under 13 has been collected without such child’s parent or guardian’s consent, we will use all reasonable efforts to delete such information from our database.

Cookies and Similar Technologies:

We may use the Channels to communicate with you, to send information that you have requested or to send information about other products or services developed or provided by us or our business partners, provided that, we will not give your contact information to another party to promote their products or services directly to you without your consent or as set forth in this Privacy Policy.

By using the Service, you expressly consent to receive in-product communications from us (including, without limitation, push notifications on the App).

By providing your phone number to us, you expressly consent to receive phone calls and/or text messages from us. We will not give your phone number to another party to promote their products or services directly to you without your consent or as set forth in this Privacy Policy.

Any phone calls and/or text messages delivered to your phone or device may cause you to incur extra data, text messaging, or other charges from your wireless carrier. Use of our platforms is governed by, and subject to, the Terms of Use located at https://www.boons.io/terms (the “Terms”). This Privacy Policy is incorporated into the Terms. Your use, or access, of the Service constitutes your agreement to be bound by these provisions. If you do not agree to the terms and this privacy policy, you may not access or otherwise use the service.

Changes to the Privacy & Cookies Policy
We may modify this Privacy Policy at any time and without prior notice. We will notify you of material changes to how we use your personal information prior to implementing them. We may notify you about such a material change by email or prominent notice on our website. By using our services and Platforms after we post these changes, you indicate that you accept them.
